Texas is a community property state. At the time of divorce, all community property is to be divided between the two spouses in a "just and right" manner. The court presumes that any property owned by spouses at the time of divorce is community property. Any debt that spouses incur during marriage is also presumed to be community debt. Separate property is generally defined as property owned by a spouse prior to marriage or property acquired by inheritance, devise, or gift during the marriage.
